AGI currently provides users with access to a collection of resources,
including but not limited to, various communications tools, personalized
content and branded programming through its network of properties. Please
note that your profile information will be publicly available to other
users. One benefit to the AGI service is to enable our users to meet
and interact with other users. To promote community, we may facilitate
interaction and communication between members. Additionally, if there appear
to be common interests between you and other users (according to your profile
information), we may send email or SMS messages that will introduce you
to others or them to you. For this purpose, we may include your greeting
and other profile information. For this community-related Service that
is provided directly to your mobile phone, you will be charged. Profile
information will NOT include personal data like your last name, email address
or phone number. Unless explicitly stated otherwise, any new features that
augment or enhance the current Service, including but not limited to the
release of new AGI properties, shall be subject to this Agreement.
You understand and agree that the Service is provided "AS-IS" and
that AGI assumes no responsibility for the timeliness, deletion,
misdelivery or failure to store any user communications or personalization
settings. Any undelivered services due to a user’s fault shall not
be refunded or warrant any credit. Unless otherwise stated, all fees on
the Service are quoted in Philippine Pesos. In order to use the Service,
you must obtain access to the World Wide Web, either directly or through
devices that access web-based content and data, and pay any service fees
associated with such access. In addition, you must provide all equipment
necessary to make such connection to the World Wide Web, including a computer
and modem or other access device. Please be aware that AGI has created
certain areas on the Service that contain adult or mature content. The
Service is offered and made available only to users 13 years of age or
older. Users at least 13 years of age but under 18 years of age should
obtain parental permission to use the Service. If you are not yet 13 years
old, you must discontinue use of the Service immediately because by using
or attempting to use the Service, you certify that you are at least 13
years of age. AGI shall not be liable for the misuse of
your account by a minor for this service. Any charges incurred by a minor
using your account shall solely be your responsibility. Please use the
services responsibly.
YOU UNDERSTAND THAT AGI MAY MODIFY SERVICES AT ANY TIME AND THAT AGI SPECIFICALLY RESERVES THE RIGHT FROM TIME TO TIME TO ALTER THE NUMBER OF MESSAGES AND OTHER SERVICES OR ELIMINATE ANY OR ALL OFFERINGS ENTIRELY AT ITS SOLE DISCRETION, WITH OR WITHOUT NOTIFICATION. Accordingly, as a legal guardian, it is your responsibility to determine whether any of the Services and/or Content is appropriate for your child. You agree to grant AGI a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicense-able (through multiple tiers), right to exercise the copyright and publicity rights you have to your Registration Data and any information you provide to AGI or other users within publicly accessible areas of the Service or through the messaging service ("Your Information"), in any media now known or not currently known. AGI will only use the Registration Data and Your Information in accordance with AGI Privacy Policy.
You may also subscribe to the Service or join groups within the Service without you registering as a user online, by following the mobile registration instructions on WWW.HOBNOBSTER.COM.PH. AGI has no means of verifying that the mobile number provided by you is actually your number. Therefore, at the moment of communicating your mobile number, you are representing to us that the mobile number being sent to us is, in fact, a mobile number belonging to you, or that you have the express authorization of the person to whom that number belongs to communicate that number to us in order to subscribe to the Service on behalf of that person. We will collaborate fully with relevant governmental authorities upon the notification of any abuse of this service by any user, and particularly, any user who communicates a mobile number to us without the authority to do so from the person to whom such mobile number belongs. In these circumstances, the Company will provide the relevant governmental authorities with all the information in its possession to identify the person(s) committing or responsible for the abuse.
You will receive confirmation of your Username upon completing the Service's registration process. You are responsible for maintaining the confidentiality of the password for your Account, and are fully responsible for all activities that occur under your password or Account. You agree to (a) immediately notify AGI of any unauthorized use of your password or Account or any other breach of security, and (b) ensure that you exit from your Account at the end of each session. AGI cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
The fees for the subscription plans to the Service you select are available on our Website. You agree to pay your mobile device carrier (“Carrier”) fees for the Service you select in accordance with the fees in effect at the time of your order. Unless otherwise indicated, the charges will be invoiced on your Carrier's bill or deducted to your prepaid account. All fees are subject to change upon notice from AGI AGI will provide you with reasonable notice of such change. If you do not accept the new fees you can opt-out of the service by following the procedure described on WWW.HOBNOBSTER.COM.PH. All fees are due immediately and are non-refundable, except as otherwise expressly noted. The subscription fee is due upon registration and you will be charged for every message you receive on your mobile phone.
This Service requires you to subscribe to a service via an opt in process
using your mobile phone. You are entirely responsible for any and all activities
that occur under your mobile phone account. You agree to notify AGI immediately
of any unauthorized use of your mobile phone account or any other breach
of security. AGI will not be liable for any loss that you may incur as
a result of someone else using your mobile phone account, either with or
without your knowledge. However, you could be held liable for losses incurred
by AGI or another party due to someone else using your mobile phone account.
The Service subscription is not transferable, such that you may not authorize
other persons to use your account. Any distribution by you of your mobile
phone account may result in cancellation of your subscription without refund
and in additional charges based upon unauthorized use.
Product fees vary and are identified as part of
the individual product description. When submitting or subscribing to a
group alert, subscription to updates, reply message, send topic via mobile
phone, block member, unblock member and register nickname and other services
provided by AGI in WWW.HOBNOBSTER.COM.PH you
will be charged by Reverse billed Premium Rate SMS. The amount will be
deducted from your cellular account. Important Notice: Your wireless-service
provider may charge you for each text message you send and receive. These
charges are in addition to the text messaging entry method fee. Please
consult your wireless-service provider regarding their pricing plans. By
joining a group within the Service, you agree to receive text messages
according to the terms of your subscription, and to pay the cost associated
with such messages, all as described on WWW.HOBNOBSTER.COM.PH
We regret that we CANNOT offer refunds if you have
disabled text messaging and/or web browsing on your phone. If you are uncertain
about whether you have disabled text messaging and/or web browsing on your
mobile phone, please check with your cell phone carrier or contact us before
you subscribe.
You understand that all information, data, text, files, graphics, links, music, photographs, software, sound, video, messages, communication or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. Accordingly, you, not AGI , are entirely responsible and liable for all activities conducted through your Account. AGI does not control the Content posted or transmitted in any way via the Service and, as such, does not guarantee the accuracy, integrity, or quality of such Content. You understand that by using this Service you may be exposed to Content that is offensive, indecent, or objectionable. the right to terminate or reassign any group, at any time, at its sole
discretion.
Commission of these or other illegal, fraudulent
or deceptive acts may subject you to sanctions, including termination of
your access to the Services, and possible civil or criminal liability.
AGI has the right, but not the responsibility, to eliminate or remove any
content or terminate any user groups that may violate these restrictions.
We reserve the right to edit, move, review or delete
any of your content for any reason, and any third parties who have engaged
AGI to operate services on their behalf may do the same. AGI may preserve
and disclose content or user information if required to do so by law or
in the good-faith belief that doing so is necessary to: (i) comply with
legal process; (ii) enforce these terms; (iii) respond to claims that any

YOU EXPRESSLY UNDERSTAND AND AGREE THAT AGI SHALL NOT BE LIABLE FOR
ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES,
INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE,
DATA OR OTHER INTANGIBLE LOSSES (EVEN IF AGI HAS BEEN ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE
SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES
RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED
OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE;
(iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
(iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY
OTHER MATTER RELATING TO THE SERVICE. AGI 'S LIABILITY, AND THE LIABILITY
OF OUR SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCES IS LIMITED
TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAID TO AGI IN THE 6 MONTHS
PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B) $1.
If you are dissatisfied with the Services or any
content on AGI , or with these Terms and Conditions, your sole and exclusive
remedy is to discontinue using the Services. You acknowledge, by your use
of the Services, that your use of the Services is at your sole risk.
No liability for actions by Carriers and AGI You
acknowledge and agree that, with respect to Carrier and AGI communications
services: (a) one hundred percent of the Messages may not be delivered;
and (b) neither AGI nor any Carrier will be liable to the user for any
Messages deleted or not delivered, regardless of the reason for deletion
or non-delivery including, without limitation, message processing or transmission
errors. Neither AGI nor any Carrier makes any representations or warranties
regarding the quality, reliability, timeliness or security of the carrier
communications services or that they will be error-free, uninterrupted,
free from unauthorized access or that all messages will be delivered.
You may not assign any of your rights or delegate any obligations hereunder, in whole or in part, whether voluntarily or by operation of law, without the prior written consent of AGI Any such purported assignment or delegation by you without the appropriate prior written consent of AGI will be null and void and of no force or effect.
If you intend to create or join any service, receive or request any news, messages, alerts or other information from the Service concerning companies, stock quotes, investments or securities, please read SUBMISSIONS again. They go doubly for you. In addition, for this type of information particularly, the phrase "Let the investor beware" is apt. The Service is provided for informational purposes only, and no Content included in the Service is intended for trading or investing purposes. Under the appropriate circumstances, it is AGI
's policy to remove and/or to disable access from the Service to web pages
of repeat infringes, and to terminate subscribers and account holders who
are repeat infringers.
This Agreement constitutes the entire agreement between you and AGI and governs your use of the Service, superseding any prior agreements between you and AGI You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. This Agreement and the relationship between you and AGI shall be governed by the laws of the Philippines without regard to its conflict of law provisions. You and AGI agree to submit to the personal and exclusive jurisdiction of the courts located within the city of Makati City. The failure of AGI to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred. The section titles in this Agreement are for convenience only and have no legal or contractual effect.
